ARGENTINIANS
ENTRY AND EXIT OF PEOPLE


“For the purpose of controlling the entry and exit of persons from the Argentine territory the National Direction of Migration (NDM) will have the following powers: a) Require identification of those trying to enter or exit from the country ... "(Section 34, point a), Exhibit I, Ministerial Resolution (MR)).

Required Documentation
To LEAVE THE COUNTRY the Argentineans must submit to the Migration Control Authority:

a) If traveling to a MERCOSUR Country Member or Associated Country:

. National Identity Card, or
. Identity Card issued by the Federal Police, or
. Enrollment Book, or
. Civic Book, or
. Valid passport without consular visa.
.Identity Card of Provincial Governments only if you are travelling to Chile and Bolivia.

The Provincial Identity Card is a legal document which allows to nationals and permanent or temporary residents of the Parties enter the geographic area known as "Iguazú Tourist Corridor" by the Tancredo Neves International Bridge, which links the towns of Puerto Iguazú (Argentina) with Foz do Iguacu (Federative Republic of Brazil), for a period of seventy-two (72) hours.
This comes out from Sections 2, 3 and 4 of the so-called "Iguazú Agreement" (Agreement on Travel Simplification between Argentina and the Federative Republic of Brazil), signed by the respective Foreign Ministers in Brasilia, on the eighteenth day of November 2009, which came into force on 12.18.2009.

b) If traveling to a country not part of the MERCOSUR or Associated State:

.Valid passport with or without consular visa, in case an omission of that requirement would exist.

TOURISTS

SECTION 24 SUBSECTIONS TO THE LAW 25.871, ORDER 616/2010


It is considered a transitional resident any foreigner who obtain from the National Direction of Migration, an admission in that nature.

TOURISTS: for rest or recreation, with sufficient means to do so. The periods of admission are up to THREE (3) MONTHS EXTENDABLE FOR ANOTHER SIMILAR PERIOD.

EXTENSION: It can be applied in the National Direction of Migration during the hours of opening form 8 to 14 hours, building number 4 section of extensions, or in the delegations from the interior of the country, or at border crossing points by the NDM.
The requests for extension of residence, and the request for change of migratory category or subcategory must be carried out within SIXTY (60) days prior to the expiration of the temporary residence and within TEN (10) days prior to expiration of the transitional residence.
The foreigner who presents himself spontaneously and voluntarily within THIRTY (30) days of expiring the periods referred to in the previous section, will suffer a surcharge of FIFTY PERCENT (50%) of the amount of the tax established for the extension of residence or change of migratory category or subcategory procedures.

Requirements:
• Valid passport or valid Identity Card (bordering countries).
• Renewal tax; MERCOSUR: $ 100. NO-MERCOSUR: $ 300
• Transitional residence in force *

* In the event that the validity of the visa has expired, SUCH RESIDENCE MAY NOT BE EXTENDED, so in order to abandon the national territory, you should apply for an AUTHORIZATION FOR LEAVING.

LEAVING AUTHORIZATION: You can apply for it at the National Direction of Migration, during the hours of 8-20 pm, at building 4, General Direction of Migratory Movement sector, or in the delegations from the interior of the country, or at border crossing points by NDM

IMPORTANT NOTE: The same is valid for TEN (10) continuous days from the date on which such Authorization is issued; during that period you will have to leave the country, if that period expires, you must request a new Authorization for leaving and pay again.
Requirements:
•Valid passport, valid identity card or valid National Identity Card of your country of origin (the latter with the countries of Brazil, Bolivia, Uruguay, Paraguay, Chile, Peru, Venezuela, Ecuador and Colombia).
•Authorization tax, MERCOSUR: $ 100. NO-MERCOSUR: $ 300

NEIGHBORING COUNTRIES MOVEMENTS (N.C.M)

SECTION 24.- Foreigners entering the country as "transitional residents" shall be admitted into any of the following subcategories:

Neighboring Countries Movements
The requirements will be set depending on the Border Countries where the procedure is enabled:

Documents to submit:

1. NCM Request
2. Proof of address, within 50 km.
3. Nationality documents in force (identity card or passport). If it is of other nationality, submit permanent resident card of Paraguayan or Brazilian also.
4. Two (02) 3 x 3 photos.

In case of minors, complete authorization, signed by both parents.

PASSENGERS IN TRANSIT Section 24 of the MR (Decree No. 616/10)

SECTION 24.- Foreigners entering the country as "transitional residents" shall be admitted into the sub-categories stated by Section 24 of Law No. 25 871, with the following results:

Passengers in transit: will differ here THREE (3) situations:

1. Passengers in transit: those entering the Argentine territory with the only purpose of going, through its territory to another State and have Argentina consular visa in that nature, with permission to stay in the country for a period of up to TEN (10) continuous days.
The NATIONAL DIRECTION OF MIGRATION may extend this period for once and for the same term when there are reasonable grounds for doing so.

2. Passengers continuing journey: those entering the country with the intention of continuing journey to another, leaving the country within TWELVE (12) hours of their arrival, submitting their confirmed departure ticket and that have been declared as such by the carrier.
The said passengers will not be required consular visa. The period of staying may be extended when there are reasonable grounds for doing so.
The reporting enterprise will be responsible for the exit from the country of these people. Passengers continuing travel that enter and must leave from the same place of their arrival, must remain within the airport, station or place of entry or exit; during the time that requires the supplying, maintenance or change of transport.
In the event of the preceding paragraph, the NATIONAL DIRECTION OF MIGRATION, at the request of the carrier and under his exclusive responsibility, may authorize the temporary removal of the passenger from the airport, station or place of entry or exit, when reasons of unforeseeable circumstances or force majeure, could delay his exit more than TWELVE (12) hours.

The NATIONAL DIRECTION OF MIGRATION may retain the personal documents of the passenger, in which case it will provide him with a certificate containing his name and surname, type and number of document and the duration of his stay in the country.
The documentation will be returned to its owner at the time of checking his real exit of the Argentine territory.
When the foreigner on continuing travel do not exit of the Argentine territory within appropriate time, the NATIONAL DIRECTION OF MIGRATION will issue an act that in its content, scope and consequences; will be equivalent to its rejection at the border, leaving the renewal on charge of the company to which belong the means of transport with which the foreigner arrived at the country.

3. Passengers arriving in the country to join as crew members or team members of a means of transport with Argentine or foreign flag: those who enter the country for that purpose shall have a period of stay of up to TEN (10) days, exceptionally renewable for another similar period .

TEMPORARY RESIDENTS

Procedures for the FIRST ENTRY

Foreigners who enter the country for the FIRST TIME as TEMPORARY RESIDENTS, to be recognized as such shall submit to the Migration Control Authority:

. PASSPORT, IDENTITY CARD or TRAVEL CERTIFICATE, valid and in force;
. Argentina CONSULAR VISA as a Temporary Resident, valid;
. ENTRY AUTHORIZATION as Temporary Resident, in force; and
. PAYMENT OF RATE of the entry authorization stated in the same document;
. ONE (1) ENVELOPE addressed to the Identifying Authority, only when they were outside ONE (1) year or more..

INTERNATIONAL TRANSPORT CREW

SECTION 24.- Foreigners entering the country as "transitional residents" shall be admitted to the sub-categories defined by Section 24 of Law No. 25 871, with the following results:

Passengers arriving in the country to join as crew members or team members of a means of transport with Argentine or foreign flag: those who enter the country for that purpose shall have a period of stay of up to TEN (10) days, exceptionally renewable for another similar period.

This type of migratory SUBCATEGORY requires CONSULAR VISA, which must be requested at the Argentina Consulate or Consular Offices

PERMANENT RESIDENTS

Procedures for the FIRST ENTRY

Foreigners who enter the country for the FIRST TIME as PERMANENT RESIDENTS, to be recognized as such shall submit to the Migration Control Authority:

-PASSPORT, NATIONAL IDENTITY CARD or TRAVEL CERTIFICATE, valid and in force;
-Argentina CONSULAR VISA as a Permanent Resident; valid;
-ENTRY AUTHORIZATION as Permanent Resident, in force;
-PAYMENT RATE permit revenue entered in the same document
-ONE (1) ENVELOPE addressed to the Identifying Authority.

One envelope will be hold by the Migration Control Authority and the other will lead to the same destination abroad.

TRANSITIONAL RESIDENTS

Procedures for the FIRST ENTRY

"To get an admission as a TRANSITIONAL RESIDENT, foreigners must submit:
- PASSPORT valid,
- ENDORSED by Argentina Consular Authority,
- UNLESS when international Covenants or Agreements, establish the requirements of additional documentation or exempt from the consular visa" (Section 1, Resolution No. 1.595/10).

PRECARIOUS RESIDENTS

Documents Required.
The PRECARIOUS RESIDENTS may freely leave and reenter the country during the period of authorized residence by proving their identity and status as such, being subject to regulations issued by the National Direction of Migration.

To LEAVE THE COUNTRY PRECARIOUS RESIDENTS must submit to the Migration Control Authority:

- Valid travel document
- Proof of Precarious Resident on time.

To REENTER the country, must submit the same documentation.
The period of residence to be given when reentering will be conferred until the expiration date of the PRECARIOUS RESIDENT.
If when leaving the country the PRECARIOUS RESIDENCE were expired, you would request an authorization of departure paying the corresponding tax.

The precarious resident certificate shall be sealed both at leaving and re-entering the country (NDM Resolution No. 3.439/76, Section 2).



I- ARGENTINES WHO DO NOT LIVE IN THE ARGENTINA REPUBLIC (EXHIBIT REGULATION 2.742/2009)

A) Argentines naturalized in countries with which the Argentina Republic has signed Agreement on Dual Nationality and bear travel document of the acquired nationality.

1– Entry

a) They will be considered foreigners and their admission to the country will be qualified as such, in accordance with regular rules apply by the acquired nationality.

b) If you state your intention to come to reside permanently in the country, you will be taken by that fact as ARGENTINE. In this case, the appropriate documentation to submit will be sealed, and under the seal will be in written form the legend "ARGENTINE AT YOUR REQUEST."

2- Exit

a) The Argentines naturalized in the countries mentioned above, will exit as any foreigner, and must carry and show the competent documents for this purpose.

b) The Argentines who have exercised the option mentioned in paragraph
a) 1.b. will have to obtain the argentine travel document to exit the National Territory.

3- Request of migration regularization being in the territory of the Argentina Republic.

a) Exit authorization, extension of stay, employment authorization, and other migration regularization requests will be considered and granted as any foreigner.

b) In the case of requesting a "Temporary Residence", it could not exceed of the two (2) years, and shall not be considered others request for "Permanent Residence".
In the latter cases, the concerned will be notified that the transfer of his domicile to Argentina Republic with the intention of residing in it permanently involves the automatic acceptance of Argentine Citizenship.

4- Application of admission to the Republic, being abroad:

a) Requests for admission as “Transitional Residents”, that because of the migratory subcategory or acquired nationality need Argentine visa, will be granted subject to compliance with applicable regulatory requirements.

b) Requests for admission as "Temporary Residents" after fulfilling the regulatory requirements in force will be granted a stay not exceeding the two (2) years.

c) Requests for admission as "Permanent Residents" are not considered, notifying to the present person that the transfer of his domicile to the Republic Argentina with the intention of residing in it permanently involves the automatic acceptance of Argentine Citizenship.

B) Argentines naturalized in countries with which the Argentina Republic has NOT signed Agreement on Dual Nationality. They will be considered, for all purposes as Argentines.

1– Entry

In the case of only submitting authorized travel document of the acquired nationality it will be inspected or will be issued the relevant card, printing the entry stamp with the legend "ARGENTINE - 180 DAYS" in handwritten under the label.

In the case, it does not appear the Argentine status on the foreign documentation and the entrant invokes it, you must prove that point by submitting Argentine National Identity Card.

2- Exit

To leave the country you should do it with the relevant Argentine documentation, except that the staying in the country has not exceeded the time limit of ONE HUNDRED EIGHTY (180) consecutive days, a circumstance which allowed you to leave with the travel document of the acquired nationality, which you had used to enter the country.


II- ARGENTINES LIVING IN THE ARGENTINA REPUBLIC

A) Argentines naturalized in countries with which the Argentina Republic has signed Agreement on Dual Nationality.

1 - Egreso:

Los argentinos naturalizados en los países antes citados, podrán egresar pudiendo portar y exhibir la documentación hábil de viaje de nacionalidad adquirida a tal efecto. Deberán acompañar, indefectiblemente, documento de identidad argentino (Documento Nacional de Identidad, Libreta de Enrolamiento, Libreta Cívica o Cédula de Identidad emitida por la Policía Federal Argentina).
La documentación hábil de viaje o la tarjeta pertinente, en su caso, será intervenida consignándose bajo el sello correspondiente la leyenda "ARGENTINO" consignándose en forma manuscrita el tipo y número de documento utilizado para el egreso.

2 - Reingreso:

Al momento del reingreso a la República, deberá presentar documento de viaje hábil argentino.
En caso de presentar solamente documento de viaje hábil de la nacionalidad adquirida en el que conste su condición de argentino, se podrá intervenir aquél estampándose el sello de ingreso con la leyenda "ARGENTINO", sin especificarse plazo alguno.
Si no constare la condición de argentino en la documentación extranjera y el ingresante la invocara, deberá acreditar dicho extremo mediante la presentación de documento de identidad argentino (Documento Nacional de Identidad, Libreta de Enrolamiento, Libreta Cívica o Cédula de Identidad emitida por la Policía Federal Argentina), para ser reconocido como tal, salvo que dicho documento de viaje hubiere sido intervenido con la leyenda "ARGENTINO" y el tipo y número de documento, al momento de su salida.

B) Argentines naturalized in countries with which the Argentina Republic has NOT signed Agreement on Dual Nationality.

1– Entry
