All those foreigners NO native of the MERCOSUR Member Countries and Associated States should initiate their application for Residence, in NON MERCOSUR Procedure Administration, Direction of Settling, the General Direction of Immigration, National Direction of Migration, or any of their offices of the interior country. For the purpose of regularizing their migration status, applicants must accompany a series of personal documents common to all types of procedures and, in addition, documents proving the adapting of each migrant to the admission criteria under which is applying for residence.

Aclaracion. Para la atención en Sede Central, Delegación La Plata o Delegacion Almirante Brown, deberá solicitar previamente su turno por internet o telefónicamente.


MIGRANT WORKER REQUIREMENTS

DOCUMENTS TO SUBMIT:

a) IDENTITY: Identity Card, Passport or Certificate of Citizenship with photo, originals. These documents must be in force and in good condition and submitted with a full set of copies including blank pages.
b) CERTIFICATE OF ARGENTINE CRIMINAL RECORDS Issued by the National Registry of Reoffend, or Federal Police. Only requires to those over 16 years.
c) CERTIFICATE OF LACK OF CRIMINAL RECORD issued by the competent authorities of the countries where they have resided for a period exceeding ONE (1) year, during the course of the last THREE (3) years. Only requires to those over 16 (sixteen) years.
d) AFFIDAVIT of lack of criminal record in other countries (it will be produce in migration at the time of application for residence). e) ENTRY. Country entry seal stamped to a travel document or migration card.

CERTIFICATE OF DOMICILE OR AN INVOICE OF ANY PUBLIC SERVICE WITHYOUR NAME (ABL, electricity, water or gas)
Settling tax:
NON MERCOSUR $ 600
TWO 4X4 COLOR PHOTOS (It must be current, taken from the front, half bust, with the head completely uncovered, color,  white even background, allowing appreciate faithfully and in all its fullness the holder's facial features when manage the procedure).

A) Labor pre-contract signed by the parties.
The pre-contract must specify:
Parties’ personal data, tasks to be performed by the foreigner, working hours, length of the labor relationship, address where the foreigner will work, remuneration to receive (it must comply with the collective bargaining agreement of the activity to be developed) and tax identification number (CUIT) of the employer.
If the employer was represented by a third party, must accompany the Power naming him.
The signatures must be certified by a notary public or before an agent of this National Direction when starting the application for residence. (In the sector report there is a model of a labor pre-contract)

B) Proof of employer's registration with the federal administration of public revenue (AFIP)
C) Proof of employer’s registration in the Single National Registry of Foreigner Applicant of the National Direction of Migration (NDM Regulation No.: 54618/08)

Note: within thirty (30) continuous days from the start of the residence application shall submit to the sector of receiving documentation, evidence of early register, issued by the federal administration of Public Revenue (AFIP) and signed by the employer.

•All documents issued abroad must have the legalization of the Argentine Consulate, located in the country issuing the document Ministry of Foreign Affairs, International Trade and Worship, or Apostille, if the country has ratified the Hague Convention .
• Without detriment of that established on international agreements or conventions in force, any documents issued by consular representatives in the national territory must have the legalization of the Ministry of Foreign Affairs, International Trade and Worship, except MERCOSUR.
• All documents issued in a foreign language must have the Spanish translation made by National Public Translator (Section 6 Law No. 20.305) and legalized by the Translators' Association.
• The documents submitted should be original and be accompanied by their respective copy, in order to proceed to their certification. The National Direction of Migration may require, if deemed necessary, additional documentation to those detailed before.

*Must prove before the NATIONAL DIRECTION OF MIGRATION the origin of the funds and their entry into the country, through banks or financial institutions authorized by the ARGENTINA REPUBLIC CENTRAL BANK. He must also prove that the amount of his income is sufficient to meet his maintenance and his primary family group. For the purposes of granting residence, it will be taken into account the regulations of Law No. 25,246 on Covering up and laundering of criminal assets. In order to access to a temporary residence as financier, the minimum amount required is $ 8,000 (EIGHT THOUSAND PESOS)

* Certificate issued by an international government or organization that certifies that you receive a pension or retirement, on a regular and permanent way, as well as the amount and duration of said benefit.
In order to prove the facts must submit documentation demonstrating your pensioner nature.

INVESTOR REQUIREMENTS

* Those who enter in this subcategory must make a productive, commercial or services investment of interest to the country, for a minimum amount of ONE MILLION FIVE HUNDRED THOUSAND PESOS ($ 1,500,000). The person concerned shall submit to the NATIONAL DIRECTION OF MIGRATION the investment project, having to prove the origin and legality of the funds, and it entries to the country, through banks or financial institutions authorized by the ARGENTINA REPUBLIC CENTRAL BANK. With the approval of the Authority mentioned in the preceding paragraph, the MINISTRY OF INDUSTRY AND TOURISM will discuss the project, its period of implementation and will issue a nonbinding opinion, taking into account the following parameters:

1. Nature of the investment;
2. Legal feasibility of the project;
3. Economic and financial sustainability of the project.

The MINISTRY OF INDUSTRY AND TOURISM may include by Resolution new parameters for evaluation. Also, it will issue additional and interpretative rules which are relevant. Received the proceedings, the National Direction of Migration will grant temporary residence, setting a deadline for the realization of the investment which will be decisive.

* If you were dedicate to scientific, technical, research and advice activities and you were hired by public or private entities to carry out works of your field, you must submit: contract linking you to the institution as well as documentation certifying your specialty (example: achieved specialty title and curriculum vitae).
* If you were managerial, technical or administrative staff of public or private foreign entities commercial or industrial and were transfer from abroad to fill specific positions in the company and earned fees or wages receivable in Argentina Republic, must submit: note of transfer and evidence that prove the link with the employer.
* Proof of employer’s registration in the Single National Registry of Foreigners Applicant of the National Direction of Migration (NDM Regulation. No.: 54618/08)

LETTER OF INTRODUCTION OF THE WORSHIP ENABLED AGENT, CERTIFIED BY THE SECRETARY OF WORSHIP, UNDER THE MINISTRY OF FOREIGN AFFAIRS INTERNATIONAL TRADE AND WORSHIP, WHERE IT IS SPECIFIED THE FUNCTION OR ACTIVITY TO BE DEVELOPED IN THE ARGENTINA REPUBLIC, ADDRESS WHERE THE TASK WILL TAKE PLACE AND WHETHER THE COMPANY WILL BE IN CHARGE OF YOUR SUPPORT AND ACCOMMODATION.

NOTE: The members of the secular clergy and ministries of religious worship recognized by the competent authority are EXEMPTED FROM PAYING MIGRATION TAX OF $ 600 ARGENTINEAN PESOS.

* Medical history stating clinical pathology and medical treatment to be followed in a health institution in THE ARGENTINA REPUBLIC.
- If the treatment is carried out in a public hospital, it must be signed by the director of the institution.
- If the treatment is conducted in a private institution or for a private physician, the professional's signature must be certified before the Argentine Health Ministry.

Note: if the medical treatment is done in children, disabled or sick, that because of the importance of his condition should remain accompanied, and this accompanying is a foreigner, the residence will be extended to the family members, legal representative or guardian submitting the personal documentation of these.

STUDENTS REQUIREMENTS

d) AFFIDAVIT of lack of criminal record in other countries (it will be produce in migration at the time of application for residence). e) ENTRY. Country entry seal stamped to a travel document or migration card.

CERTIFICATE OF DOMICILE OR AN INVOICE OF ANY PUBLIC SERVICE WITH YOUR NAME (ABL, electricity, water or gas)

FORMAL STUDENT MUST SUBMIT: COMPLETE PERSONAL DOCUMENTATION AND ELECTRONIC REGISTRATION CERTIFICATE.

NO FORMAL STUDENT MUST SUBMIT: COMPLETE PERSONAL DOCUMENTATION (ONLY IF THE COURSE IS LONGER THAN 6 (SIX) MONTHS) AND ELECTRONIC REGISTRATION CERTIFICATE.

EXCHANGE STUDENT, MUST SUBMIT: COMPLETE PERSONAL DOCUMENTATION (ONLY IF THE COURSE IS LONGER THAN 6 (SIX) MONTHS). ELECTRONIC REGISTRATION CERTIFICATE, EXCHANGE STUDENT PROGRAM BETWEEN THE EDUCATIONAL INSTITUTIONS.

PARTIAL STUDENT MUST SUBMIT: COMPLETE PERSONAL DOCUMENTATION (ONLY IF THE COURSE IS LONGER THAN 6 (SIX) MONTHS). ELECTRONIC REGISTRATION CERTIFICATE.

MINORS: Foreigners, who were under eighteen (18) years, must have authorization from a parent who must turn up at the time of the procedure with national identity card in force and birth certificate legalized that proves the family relationship. To be authorized for such purposes, the same shall be signed by competent authority. In the event that the child's parents do not reside in the National Territory, the child must have an appointed guardian, who must prove legal residence in the country and demonstrate to the public document his appointment as guardian of the child. These documents (birth certificate and power issued abroad), must be properly legalized by the Argentine Consulate of that country or apostille of the Hague Convention or legalized by the consulate of the country issuing the document established in Argentina (only documents issued in countries belonging to MERCOSUR).

NOTE: EDUCATIONAL INSTITUTIONS MUST BE REGISTERED BEFORE THIS NATIONAL DIRECTION AND GRANT THE CERTIFICATE OF REGISTRATION TO THE CONCERNED DETAILING THE TYPE OF STUDY TO BE ATTENDED.

THE RESIDENCE TO GIVE WILL BE TEMPORARY OR TRANTISIONAL ACCORDING TO THE STUDIES

IMPORTANT:
*All documents issued abroad must have the legalization of the Argentine Consulate, located in the country issuing the document Ministry of Foreign Affairs, International Trade and Worship, or Apostille, if the country has ratified the Hague Convention .
*Without detriment of that established on international agreements or conventions in force, any documents issued by consular representatives in the national territory must have the legalization of the Ministry of Foreign Affairs, International Trade and Worship, except MERCOSUR.
*All documents issued in a foreign language must have the Spanish translation made by National Public Translator (Section 6 Law No. 20.305) and legalized by the Translators' Association.
*The documents submitted should be original and be accompanied by their respective copy, in order to proceed to their certification. The National Direction of Migration may require, if deemed necessary, additional documentation to those detailed before.

• If you are a refugee: certification issued by the NATIONAL COMMISSION FOR REFUGEES (CO.NA.RE), attesting your refugee status.
• If you are asylum: certification issued by the organization giver of asylum that certifies that point. Note: Those who are recognized as refugee or asylums are exempt from paying the tax of migration (Section 2, iv Order 231/09)

FOREIGNERS WHO INVOKE HUMANITARIAN REASONS JUSTIFYING BY THE NATIONAL DIRECTION OF MIGRATION FOR SPECIAL TREATMENT, will be taken into account the following situations:

1) People in need of international protection, which are not refugees or asylum in the terms of the applicable law on the subject, are protected by the Principle of No Return and cannot regularize their migratory status through the remaining judgments of law 25.871 and its regulations.
2) Persons of which is deemed likely, that if were forced to return to their country of origin would be subject to violations of human rights recognized in international documents with constitutional status.
3) People who have been victims of human trafficking or other forms of slave holding and / or victims of smuggling.
4) People who claim health reasons to suspect risk of death if they were forced to return to their home country due to lack of medical treatment.
5) Stateless persons and refugees who have resided in the country for a period of more than THREE (3) years and his condition had ceased.

When there are grounds of public interest, the HOME MINISTRY, through the NATIONAL DIRECTION OF MIGRATION, and the MINISTRY OF FOREIGN AFFAIRS, INTERNATIONAL TRADE AND WORSHIP may adopt joint resolutions that provide others categories of admission as temporary residents.

To preserve the principles of unity, support and family reunification with the scope set out in the relevant legislation and Section 10 of Order 616/2010, the National Direction of Migration, will grant temporary residence to who states:

• Be the spouse, parent or unmarried child under EIGHTEEN (18) years not emancipated or adult with disabilities, of an immigrant with temporary residence.
For this must show:
• Birth certificate or marriage certificate legalized, attesting to the alleged family relationship.
• A document certifying the status of TEMPORARY resident.
